Partnership with the Federal Association of German Foundations

dtb rechtsanwälte has been advising on foundation law issues for many years. After many years of co-operation with the Federal Association of German Foundations, we are now also an official founding partner of the association. The association represents the interests of more than 22,000 foundations in Germany. Together with the association, we want to develop revenue-generating foundation models in order to make charitable activities profitable in the long term. Cultural Values and Property: New Article in FAZ

The dispute between the state of Hesse and the finder of an ancient Roman horse's head over an appropriate finder's fee has been going on for a good ten years. Bertold Schmidt-Thomé is representing the farmer on whose property the bronze horse's head, now on display in the Saalburg Museum, was found. The discovery of the ancient relic was not only a sensation for archaeologists. In terms of monument law, this unusual case deals with the exciting question of how archaeological finds can be appropriately evaluated using different categories of work, such as "artistic" or "historical" significance.

Prevention of Money Laundering

On Monday afternoon in the Mendelssohn-Remise, more than 90 guests from the gallery and art trade world learnt about the solution model that dtb rechtsanwälte has developed in cooperation with the compliance specialist Kerberos Compliance from Cologne in order to make the art market fit for the requirements of the EU's 5th Money Laundering Directive. There was a lot of positive feedback and lively legal policy discussions. The programme was rounded off with an interesting presentation by our cooperation partner Dr Stephan Zilkens, Zilkens Fine Art Insurancebroker GmbH, on the various ways of insuring art financing under insurance law.

Best Lawyers and Handelsblatt have once again included Pascal Decker in the list of Germany's best lawyers in the field of art law. The American specialist publisher Best Lawyers is one of the oldest and most renowned lawyer rating services in the world. For over 30 years, the publisher has been compiling and publishing recommendation lists of the best lawyers in 75 countries worldwide in over 140 practice areas, in Germany exclusively in co-operation with the Handelsblatt.
The result of the Best Lawyers rating was published in the Handelsblatt in the issue of 28/29/30 June 2019, p. 44 - 49, and can be viewed both via the search function at Handelsblatt Online and on the bestlawyers website.

Stakeholders from the art market and experts from the compliance sector addressed the highly topical issue of what impact compliance requirements have on the art market and how they can be sensibly implemented.

A Law for Art: Bertold Schmidt-Thomé as a Lecturer at the European Outsider Art Association in Stockholm

Partner Bertold Schmidt-Thomé took part in the EOA conference as a guest speaker and spoke about the Geyso20 Foundation, an organisation run by Lebenshilfe Braunschweig. Here, people with disabilities are given the freedom and space to work creatively. Numerous legal issues had to be clarified for both the works of the studio's artists and its guest artists before they became part of the collection of an outsider art studio. Who owns the artworks? Who has the rights of use to the artworks created to date?

 

To name just a few of the essential questions that had to be examined under German law before the foundation could be established. Bertold Schmidt-Thomé explained these questions with his in-depth knowledge of art law and took on a task that was not only exciting but also socially more than enriching.

In an entertaining dialogue with Dr. Pascal Decker, Bertold Schmidt-Thomé explained how to transfer works of art in a tax-optimised manner. Under the heading "The Art of Passing on Art", numerous collectors listened with interest to the explanations at the Salon Bastian in Berlin and at Kunkel Fine Arts in Munich.
